MONEY TRANSFER TERMS AND CONDITIONS

EFFECTIVE 01 MAY 2010


These terms and conditions apply to and govern your access to and use of the Voxstone online website and the services available on the Voxstone online website.

It is important that you read and understand our terms and conditions before you accept them. They contain limitations on the scope of our obligations to you, as well as limitations on and exemptions from our liability to you in the event that you suffer loss as a result of using our services.

1.0 DEFINITION OF TERMS
  1. "prohibited purpose" refers to any unlawful purpose and include, but not limited to fraud, money laundering, terrorism financing, financial crime or such other purposes;
  2. "recipient" refers to the person identified as the beneficiary of a money transfer (whether that money transfer is initiated by a sender using the Voxstone Online Service or by a person using another Voxstone money transmission service);
  3. "sender" refers to the person who initiates the carrying out of a money transfer by using the Voxstone Online Service;
  4. "transaction" refers to each money transfer that you initiate under, and each other use that you make of, the Voxstone Online Service;
  5. "Voxstone", "we", "our" or "us" refers to Voxstone which is the trading name of Business Links International Limited, a company incorporated in England and Wales No. 05501337 and, includes affiliate or agent of Voxstone when performing a task which would otherwise have to be performed by Voxstone in connection with its provision of the Voxstone Online Service;
  6. "Voxstone Online Service" refers to any or all of the services which are made available by us by means of the Voxstone website;
  7. "Voxstone Online Site" or "Site" refers to the website operated by us to provide online money transmission services and related information facilities; and
  8. "You" or "your" refers to any person who uses the Voxstone Online Site or the Voxstone Online Service, whether as a sender or as a recipient.
2.0 CHANGES TO OUR TERMS AND CONDITIONS

We may change our Terms and Conditions from time to time. We will notify you of any change to our Terms and Conditions by posting a clear and readily accessible notice of change on the Voxstone Website. No change which we may make will affect the terms on which you used the Voxstone Online Site, or on which we provided the Voxstone Online Service to you, before we posted the notice of change on the Site. If at any time you do not agree with our terms and conditions, or any update thereon, you must stop using the services immediately.

3.0 OUR RESPONSIBILITY TO YOU
3.1 Our agreement with you is that we will take reasonable care to provide the Voxstone Online Service. As such, we agree to provide you with the money transmission services and the related information facilities described from time to time on the Voxstone Online Site.

3.2 We will generally rely without further enquiry on messages that are transmitted through the Voxstone Online Site and actually received by us, unless we have actual notice that any such message is incorrect, unauthorized or forged.

3.3 We do not accept any responsibility to you for:
a) the goods or services which you pay for by using the Voxstone Online Service;
b) malfunctions in communications facilities which cannot reasonably be considered to be under our control and that may affect the accuracy or timeliness of messages you send to us;
c) any losses or delays in transmission of messages arising out of the use of any Internet access service provider or caused by any browser or other software which is not under our control;
d) viruses caused by third parties;
e) errors on the website or with the Voxstone Online Service caused by incomplete or incorrect information provided to us by you or a third party;
f) any unauthorized use or interception of any message or information before it reaches the Site; or
g) Any unauthorized use of or access to data relating to you or your transactions which is held by us (unless such use or access is caused by our negligence, fraud or failure to comply with laws relating to the protection of your data).


3.4 We have no obligation to you to initiate or perform a money transfer or other transaction as part of the Voxstone Online Service if:
a) we are unable to obtain satisfactory evidence of your identity;
b) we have reason to believe that the transaction message is incorrect, unauthorized or forged;
c) you provide us with incorrect or incomplete information or if your transaction message is not given to us sufficiently in advance to allow for timely provision of the requested transaction; or
d) we fail to obtain payment for the transaction; and we do not accept any liability for damages resulting from non-payment or delay in payment of a money transfer to a recipient or failure to perform a transaction under the Voxstone Online Service by reason of any of these matters.


3.5 We may refuse to provide the Voxstone Online Service (in whole or in part) to you if to do so may breach any applicable law, order of a court or requirement of any regulatory or governmental authority, body or agency having jurisdiction over us, or if we otherwise consider such action necessary to protect our interests. However, if we refuse to provide the Voxstone Online Service (in whole or in part) for any of these reasons, we will wherever practicable notify you that we have done so and, unless we are prevented from doing so for some legal reason, we will explain why we have done so.

3.6 We may suspend the operation of the Voxstone Online Site or the Voxstone Online Service in whole or in part if, in our absolute discretion, we consider it appropriate to do so by reason of any circumstances beyond our control. We undertake that if the services provided by the Voxstone Online Site or the Voxstone Online Service are interrupted (whether by us, any third party service provider or otherwise) for any reason we will take reasonable care to minimize the duration of any interruption. Provided we comply with this undertaking, we shall not be liable to you for any loss or liability which may be suffered or incurred by you as a result of any such interruption, even if caused by our negligence, except where any such interruption is caused by our fraud.

3.7 We will generally communicate with you through the Internet and by email. This enables us to keep our overheads low and offer you cheap service in return. This does not affect your right to communicate with us by any other means.

4.0 YOUR RESPONSIBILITY
4.1 You acknowledge and agree that:
a) when you register with us, you will provide us with true, accurate, current and complete information;
b) you are over 17 years of age.
c) you will maintain and promptly update such information to keep it true, accurate, current and complete;
d) you authorise us to validate the information you provided to us with independent parties such as credit reference agencies;
e) you will not use the Voxstone Online Service for or in connection with any prohibited purpose;
f) you will not initiate a money transfer or other transaction under the Voxstone Online Service in breach of these Terms and Conditions or any other restriction or requirement of use described on the Voxstone Online Site; and
g) You are responsible for the security of your password and email account log-in.

4.2 You acknowledge and agree that information about you, and the services we provide to you, may be provided by us from time to time to regulatory or governmental authorities, bodies or agencies where:
a) are required by law to do so; or
b) If we determine that such disclosure may help to combat fraud, money laundering offences or other criminal activity.


4.3 You agree that you will generally communicate with us through the Internet and by email. This does not affect your right to communicate with us by any other means.

5.0 FOREIGN EXCHANGE RATE
5.1 All currency converted under the Voxstone Online Service is converted at our rate of exchange. Thus, any amount notified to you at the time the transfer was initiated may be subject to exchange rate fluctuations between the time of transfer and the time we received cleared funds into our account. We will generally convert your currency at the time we receive cleared funds from you in payment for your transfer.

5.2 We use an exchange rate which is comparable to rates used by bureau de change and other retail currency exchange facilities which offer exchange of comparable amounts of currency to the general public. Our exchange rate may be less favourable than some publicly reported commercial exchange rates used in transactions between banks and other financial institutions. Any difference between the currency exchange rate offered to you and the currency exchange rate received by us will be kept by us or our payout partners, in addition to our charges.

6.0 CIRCUMSTANCES BEYOND OUR CONTROL

We are not liable to you if we are unable to perform any of our obligations to you or our performance of any of our obligations is delayed due to any circumstances outside of our reasonable control, including (without limitation) any industrial action, labour dispute, act of God, fire, flood or storm, war, riot, civil commotion, siege, security alert, act of terrorism or any resulting precautionary measures taken, act of vandalism, sabotage, virus, malicious damage, compliance with any statute, statutory provision, law, governmental or court order, the actions or instructions of the police or of any governmental or regulatory body which authorises us to perform Our Services, cut or failure of power, failure of equipment, systems or software or internet interconnectivity or the occurrence of any extraordinary fluctuation in any financial market that may materially adversely our ability to execute your transfer instruction.

7.0 REFUSAL TO PERFORM A MONEY TRANSFER OR CURRENCY EXCHANGE
7.1 We may refuse to perform a Money Transfer or Currency Exchange at any time for any reason.

7.2 Where we refuse to perform a Money Transfer or Currency Exchange:
a) unless it is unlawful for us to do so, we will tell you;
b) if possible, we will let you know our reasons for our refusal; and
c) if the refusal is due to any factual errors, we will tell you what these are and how to correct them.
8.0 LIMITATION OF LIABILITY FOR A MONEY TRANSFER

Our total liability to you in connection with a Money Transfer, Currency Exchange or any of the services offered on our website is limited to the full refund of the amount paid by you for the service. We reserve the right to retain any fee we have charged.

9.0 INTERMEDIARIES FEES ON INTERNATIONAL PAYMENTS

In some circumstances, foreign banks may deduct charges from the receiver’s account with respect to international payments. These fees may not always be calculated in advance, and as such you agree to be liable for these fees, unless we waive it at our discretion.

10.0 NON ADVISORY ROLE

We are not providing any advice (whether to enter or not to enter into a foreign exchange transaction, or the timing thereof) in respect of any transaction you initiated or instructed us to execute for you. Where we provide market information, this is not an advice, and as such you should not infer anything beyond the data or information we provide. We cannot accept responsibility for your decision to enter into a foreign exchange transaction.

11.0 CANCELLATION OF A TRANSACTION OR CURRENCY EXCHANGE CONTRACT

If after initiating a money transfer transaction or you have entered into a currency exchange contract with us, you informed us that you wish to cancel the contract, or this agreement allows us to treat you as having cancelled the contract (a cancellation event), we may terminate the contract at our complete discretion, but where we consider it necessary, we may insist that you perform the contract.

We may treat your death, illness, threat of legal action against you, an insolvency event (including presentation of petitions, arrangements with creditors, appointment of administrators or receivers or the levying of distress) occurring against you as being cancellation.

If you cancel or fail to perform a contract, we will normally enter a second (buy or sell) transaction matching the one being cancelled to close our position in the market. Most likely, the exchange rates on the two matching contracts will not be the same. In the event that we suffer loss, we will charge you for the loss incurred. We also reserve the right to charge an administrative fee of £40 representing costs involved in the cancellation. We will set off our fee and loss incurred against any deposit or funds received from you, or where these do not exist, we will request you to send us funds to cover the fee and losses incurred.
